In the State of Illinois, child support payments are determined according to statutory guidelines. Changes to Illinois Child Support Guidelines in 2017

Following an update to the Illinois Marriage and Dissolution of Marriage act which took effect in July of 2017, child support payments are no longer based solely on the net income of the non-custodial parent. Under the updated law, courts will use charts provided by the Illinois Department of Healthcare and Family Services to determine the amount of money needed to care for a child based on the parents' combined net income, and each parent will be responsible for a portion of this amount based on the percentage that their individual income contributes to the combined income. Parents' individual amounts of parenting time and parental responsibility will also be considered when determing the amount of child support

The guidelines for calculating child support payments are straightforward. The court may, however, make a determination that these guidelines are not appropriate after considering the needs and interests of the child(ren). The court can consider a number of factors to deviate from these guidelines including:

  • The financial circumstances of the custodial parent
  • The financial circumstances of the non-custodial parent
  • The standard of living the child(ren) would have enjoyed if the parents were married
  • The physical, emotional and educational needs of the child(ren)
