In the State of Illinois, child support payments are determined according to statutory guidelines that stipulate a specific percentage of a paying parent’s income as a support obligation. Deviations to Illinois Child Support Guidelines

Statutes outlining child support guidelines in Illinois are rather straightforward. These guidelines are based on the paying spouse’s net income and the number of minor children as follows:

  • For one child: 20%
  • For two children: 28%
  • For three children: 32%
  • For four children: 40%
  • For five children: 45%
  • For six or more children: 50%

These percentages represent the minimum child support order. The court may, however, make a determination that these guidelines are not appropriate after considering the needs and interests of the child(ren). The court can consider a number of factors to deviate from these guidelines including:

  • The financial circumstances of the custodial parent
  • The financial circumstances of the non-custodial parent
  • The standard of living the child(ren) would have enjoyed if the parents were married
  • The physical, emotional and educational needs of the child(ren)
